Nabaa Terms of Service

These Terms of Service ("Terms", "Terms of Service", "Terms and Conditions") govern your relationship with nabaapp mobile application and nabaapp.com website (the "Service") operated by Madarsoft. ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our nabaapp mobile application or nabaapp.com website (the "Service").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Madarsoft.

Third-party Services

The Service uses the YouTube API Services. By using the Service, you are agreeing to bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). The Google Privacy Policy is available at https://policies.google.com/privacy.
You can revoke the Service's access to your Google data at any time via the Google security settings page at https://security.google.com/settings/security/permissions.

Links To Other Web Sites

Our Service may display content posted by third-party web sites or services, and/or links to third-party web sites or services that are not owned or controlled by Madarsoft.
Madarsoft has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Madarsoft shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Limitation Of Liability

In no event shall Madarsoft, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or altera based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Madarsoft its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
These Terms may be modified from time to time. The date of the most recent revisions will always be at https://nabaapp.com/terms, If we make changes that we believe will substantially alter your rights, we will notify you by posting a notice on our website. You agree to accept any changes or revisions to these Terms by continuing to use our Service.

Nabaa Premium Supplementary Terms and Conditions

The Services may also include access to certain optional features and services. The Nabaa Premium service is a collection of premium services that are available only under these Supplementary Terms and Conditions in addition to the Terms of Use (collectively, the "Agreement") and subject to your payment of the fees referenced below.

Access to Nabaa Premium Service

Currently, Nabaa Premium service is accessible only via our mobile application " Nabaa " on an iOS or Android device.

Nabaa Premium Service Termination / Cancellation

You may terminate this Agreement at any time by canceling your subscription through your iTunes subscription settings page or your Google Play subscription settings page. There are no refunds for any fees paid. YOU ARE RESPONSIBLE FOR TERMINATING YOUR ACCOUNT AND THIS AGREEMENT AND WE ARE NOT RESPONSIBLE FOR YOUR FAILURE TO PROPERLY TERMINATE YOUR SERVICE AND THIS AGREEMENT NOR FOR ANY CHARGES AND FEES YOU INCUR AS A RESULT OF NOT PROPERLY TERMINATING YOUR SERVICE AND THIS AGREEMENT.

Fees for the Nabaa Premium monthly service

If you opt to sign up for the Nabaa Premium service monthly subscription plan, you will be subject to monthly subscription fees in accordance with the Fee Schedule and related information (the "Fee Schedule"). You will be required to submit payment monthly in advance for access to the Nabaa Premium service. We reserve the right to disable access to the Nabaa Premium service until payment is received. Fees will be billed monthly on an ongoing and recurring basis even if you are not actively using the Nabaa Premium service.

Fees for the Nabaa Premium semi-annual service

If you opt to sign up for the Nabaa Premium service Semi-Annual subscription plan, you will be subject to Semi-Annual subscription fees in accordance with the Fee Schedule and related information (the "Fee Schedule"). You will be required to submit payment Semi-Annually in advance for access to the Nabaa Premium service. We reserve the right to disable access to the Nabaa Premium service until payment is received. Fees will be billed Semi-Annually on an ongoing and recurring basis even if you are not actively using the Nabaa Premium service.

Fees for the Nabaa Premium annual service

If you opt to sign up for the Nabaa Premium service yearly subscription plan, you will be subject to annual subscription fees in accordance with the Fee Schedule and related information (the "Fee Schedule"). You will be required to submit payment annually in advance for access to the Nabaa Premium service. We reserve the right to disable access to the Nabaa Premium service until payment is received. Fees will be billed annually on an ongoing and recurring basis even if you are not actively using the Nabaa Premium service.

Fee Schedule

You are responsible for reviewing the Fee Schedule from time to time and remaining aware of the fees charged by us and any applicable discounts. The Fee Schedule, including subscriber or any discounts, is subject to change at any time in our sole discretion.

Your Fee Schedule, and next billing date and amount can be found in your iTunes account's or Google Play Store account's subscription management page.

Payment

Payment for the Nabaa Premium service must be made via your iTunes account or Google Play Store account. Amounts paid for the Nabaa Premium service, including prepayments, are not refundable by us.
